Terms and Conditions

These Terms and Conditions govern your access to and use of the QuadScale Zero Trust Network Access (ZTNA) platform, including our cloud service, agents, APIs, documentation, and related offerings.

Last updated: May 27, 2020

1. Agreement to terms

By creating an account, installing a QuadScale agent, accessing our control plane, or otherwise using our services, you agree to these Terms and Conditions ("Terms"). If you use QuadScale on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.

If you do not agree to these Terms, do not use QuadScale.

2. Description of service

QuadScale provides a Zero Trust Network Access platform based on WireGuard mesh networking. The service enables secure connectivity between authorized users, devices, servers, Kubernetes clusters, and cloud environments through features such as identity-based access control, NAT traversal, subnet routing, exit nodes, relay fallback, audit logging, and API-driven automation.

QuadScale may offer cloud-hosted and self-hosted deployment options. Features available to you depend on your selected plan, configuration, and product version.

3. Account registration and security

You agree to:

  • Provide accurate and current registration information.
  • Maintain the confidentiality of credentials, API tokens, and auth keys.
  • Promptly notify us of unauthorized access to your account or control plane.
  • Ensure users in your organization comply with these Terms and your internal policies.

You are responsible for all activity under your account, including network policies, device enrollments, route advertisements, and integrations configured by your administrators.

4. Acceptable use

You may use QuadScale only for lawful purposes and in accordance with these Terms. You must not:

  • Use the service to access systems or data without proper authorization.
  • Attempt to bypass identity checks, ACLs, device posture requirements, or rate limits.
  • Probe, scan, or test the vulnerability of QuadScale infrastructure without written permission.
  • Transmit malware, conduct denial-of-service attacks, or interfere with other users or relays.
  • Misrepresent device identity, spoof endpoints, or share enrollment credentials improperly.
  • Use exit nodes or subnet routers to route unlawful, abusive, or prohibited traffic.
  • Reverse engineer the service except where permitted by applicable law.

We may suspend or terminate access if we reasonably believe your use violates these Terms, poses a security risk, or could harm QuadScale or third parties.

5. Customer responsibilities

As a Zero Trust networking platform, QuadScale relies on correct customer configuration. You are responsible for:

  • Defining appropriate access policies, groups, and least-privilege rules.
  • Managing identity provider integrations, MFA enforcement, and user offboarding.
  • Securing devices enrolled in your mesh and maintaining endpoint hygiene.
  • Reviewing advertised routes, subnet routers, and exit node assignments.
  • Monitoring audit logs and responding to security incidents in your environment.
  • Ensuring your use complies with applicable laws, regulations, and contractual obligations.

6. Free, paid, and enterprise plans

Certain features are available at no charge subject to usage limits described on our pricing page. Paid subscriptions are billed according to the plan selected at signup or in your order form.

Fees are non-refundable except where required by law or expressly stated in an order form. We may change pricing or plan features with reasonable notice. Continued use after a pricing change constitutes acceptance unless you cancel before the change takes effect.

Enterprise customers may be governed by a separate order form or master services agreement. If there is a conflict, the signed enterprise agreement prevails.

7. Service availability and changes

We strive to maintain a reliable ZTNA platform but do not guarantee uninterrupted availability. Maintenance, relay rebalancing, control plane updates, and factors outside our control may affect connectivity. We may modify, suspend, or discontinue features with reasonable notice when practicable.

Beta or preview features are provided as-is, may change without notice, and may not be covered by support or SLA commitments unless otherwise agreed in writing.

8. Intellectual property

QuadScale and its licensors retain all rights in the platform, software, documentation, branding, and related materials. We grant you a limited, non-exclusive, non-transferable license to use the service during your subscription or trial in accordance with these Terms.

You retain ownership of your configuration data, policies, and content. You grant QuadScale the rights necessary to host, process, and transmit that data solely to provide and secure the service.

9. Confidentiality and data protection

Each party will protect the other's confidential information using reasonable care and use it only for purposes related to the service. Our handling of personal data is described in our Privacy Policy. Enterprise customers requiring a Data Processing Agreement may request one at legal@quadscale.io.

10. Third-party services

QuadScale integrates with third-party identity providers, cloud platforms, MDM/EDR tools, SIEM systems, and infrastructure providers. We are not responsible for third-party services, and your use of them is governed by their respective terms. Enabling an integration may require sharing configuration or event data with that provider as configured by you.

11. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUADSCALE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, COMPLETELY SECURE, OR MEET ALL CONNECTIVITY REQUIREMENTS IN EVERY NETWORK ENVIRONMENT.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUADSCALE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO QUADSCALE FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (USD $100) IF YOU USE A FREE PLAN.

13. Indemnification

You will defend, indemnify, and hold harmless QuadScale from claims, damages, liabilities, and expenses arising from your use of the service, your network policies, traffic routed through your exit nodes or subnet routers, your violation of these Terms, or your violation of applicable law or third-party rights.

14. Termination

You may stop using QuadScale at any time. We may suspend or terminate your access if you breach these Terms, fail to pay applicable fees, or if continued service poses a security or legal risk.

Upon termination, your right to use the service ends. We may delete or deactivate accounts and associated configuration data after a reasonable retention period, subject to legal and billing requirements. Sections that by nature should survive termination will remain in effect.

15. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, excluding conflict of law principles, unless mandatory local law requires otherwise. Disputes will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction, except where prohibited by applicable consumer protection laws.

16. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through the control plane, by email, or on this page. Your continued use of QuadScale after updated Terms become effective constitutes acceptance of the revised Terms.

17. Contact
